Guest/s: Includes any adult who is 18 years of age or older who is making the reservation and is acting on behalf of other guests attending during the reservation period.
 
By completing a reservation online at our Booking Website, or with Property Owners in person, Guest, agrees to the following terms and conditions of this reservation policy for a short-term stay at the Property.


1. TERM: The Term of lease shall begin on the arrival date booked and end on the departure date booked for the number of nights stated in the completed reservation. The Property will be ready for occupancy no earlier than 2 pm on the arrival date and must be vacated no later than 11 am on the departure date, unless alternative times have been pre-arranged with Property Owners.


2. PRICES: The rental prices are those that are stated on the Booking Website at the time of reservation. Rates for "weekend" nights include Friday and Saturday nights and rates for "weeknights" include Sunday through to Thursday nights. Guest must pay the price of the reservation in full to complete a booking, unless otherwise arranged with Property Owners. The rental price includes the rental of the cabin and within the near area surrounding it that is fenced on one side and signposted on the other side. Price also includes the cost of laundering, power, gas, water, and the cost of consumables provided. There is a two-night-minimum booking requirement, unless otherwise arranged with Property Owners. Prices can fluctuate depending on seasons, peak-times and at Property Owner’s discretion. Discount codes may be used if made available to Guest. Maximum stay is 14 days per reservation. Extra towels and provisions will be provided for longer stays.


3. ACCOMMODATION SITE: The accommodation site of the Property includes the 47sqm cabin and gated area around the deck, all driveways into and around the Property, and some bush area immediately surrounding it. The accommodation site map is included within the Guest Information book on site. 


4. PAYMENTS: The following payments are due at the time of reservation: 100% of rental price to secure reservation, mandatory cleaning fee, optional porta-cot, optional extras (e.g. "cheeseboard provisions"). Guest can also negotiate add-ons with Property Owners after reservation has been completed.


5. LIMITED OCCUPANCY: Occupancy is limited to a maximum of two adults and one infant/toddler. If Property Owners conclude that this policy has been breached, then Property Owners reserve the right to expel the entire party with no refund. A child of Guest stay for free if porta-cot and extras do not need to be prepared. Guest must notify Property Owners if their young child is staying so a woodheater guard can be supplied. Visitors of Guest are not permitted unless pre-arranged with Property Owners.


6. EXTRAS: One porta-cot can be reserved by Guest for an additional fee. This option is chosen and payment made at the time of reservation as an add-on. When this option is selected, Guest will receive a porta-cot, night light, children’s books, toys, a chair for nursing, and a guard for the woodheater. The porta-cot includes fresh linens, pillow, and blanket. If the porta-cot is not required by Guest, then child stays for free with Guest supplying their own porta-cot if needed. Child must be of an age suitable for a porta-cot sized bed. Parents of child agree to pay all and any damages made by child. All edible extras paid for at check-out are subject to availability and accessibility for Property Owner. A full or partial refund will be given if items cannot be adequately substituted and delivered as expected.

7. VOUCHERS: Vouchers can only be purchased and organised with Property Owners through the business email stay@clearyscorner.com. Vouchers are valid for one year from purchase unless otherwise negotiated by Property Owner and Guest. Vouchers are valid for the amount or description shown on the voucher dispensed by Property Owner. Guests must adhere to the 2-night-minimum stay booking rule unless otherwise negotiated with Property Owner. Vouchers cannot be exchanged for cash. Vouchers cannot be used for online bookings. Guests must contact Property Owners to arrange a booking with a voucher. 


8. NON-DISTURBANCE CLAUSE: Guests shall not disturb, annoy, endanger (e.g. fireworks) or inconvenience neighbours, nor use the premises for any unlawful purposes.


9. CARE OF PREMISES/DAMAGES: Property Owners may evict Guests without refund if substantial damage to the Property Owner’s property occurs. Guest agrees to pay the Property Owner for any substantial damages to furnishings, household items, land or building that occurs due to Guest’s occupancy. This will include payment of any additional cleaning charges over $80 incurred due to Guest’s occupancy.

10. HOUSE RULES: By making a reservation with Property Owners, Guest agrees to the following rules:

  • No pets

  • No visitors

  • No smoking inside the cabin or next to open windows and doors

  • No feeding of wildlife or unsafe behaviours around them

  • The gated area around the deck must be kept closed from dusk till dawn or when premises is vacated, to keep wildlife out

  • Heed all warning signs on the Property

  • Read Guest Information before arriving or during the stay, particularly regarding the Bushfire Evacuation Plan during hot and dry summer months

  • Leave the Property in an orderly condition

  • Notify Property Owners of anything that is not up to standard as soon as possible so Property Owners can rectify as soon as possible

  • Notify Property Owners of any damage occurred during Guest stay

  • Notify Property Owners of any emergencies that occur at the Property (Guests may visit Property Owners' home residence if phone calling is inhibited)

11. ROADS & PARKING:  Roads leading to the Property are unsealed. Guest should be aware that this may affect car hire insurance. There is a large parking space available for Guest cars/car with trailer, on the Property and space to turn around.


12. PHONE RECEPTION/WIFI: There is some/limited phone reception for Telstra network users. There is no WiFi available at this property currently. A WiFi service is planned for February 2025. The Property Owner will supply a mobile phone on the Telstra network that Guests can use for texts and calls but not for data. Guests can drive out towards the highway for better phone reception or for emergencies can visit Property Owner's home residence.


13. QUARRY-RELATED NOISE: The Property is located nearby a quarry that occasionally operates. Guest understands that there may be some noise from machinery or some heavy truck traffic on Clearys Lane that is out of Property Owners' control. Property Owners will do as much as is in their control to limit the noise of loud machinery by negotiating with quarry management before the arrival of Guest. No refunds or discounts will be offered to guests unless substantial noise is experienced during the term of lease.

14. COMMERCIAL ACTIVITIES: No commercial activities of any kind (including, but not limited to, photoshoots and video shoots) are permitted at Clearys Corner unless prior written consent by Property Owners has been obtained (which may be withheld in Property Owner's absolute discretion).


15. OWNERS' RIGHTS: Guest agrees that if the conditions and limitations set forth herein are not met, Property Owners shall have the right to cancel the stay and may enter the Property, either by statutory proceedings or by force, to inspect the Property and ensure that Guest has vacated the Property. All monies paid by Guest shall be forfeited as liquidated damages.


16. INDEMNITY CLAUSE: All Guests agree to indemnify and hold Property Owners harmless from any liability for personal injury or property damage sustained by Guest or individuals invited onto the Property by Guest.
 

17. REPAIRS AND MAINTENANCE: The Property is rented with Property Owners' furniture and household furnishings. Property Owners shall not be responsible for providing additional furnishings or equipment not presently available at Property. Guest will report any maintenance issues immediately to the Property Owner. The Property Owner will make every effort to repair and/or replace any equipment that is not working properly but cannot guarantee that all equipment and utilities are always in good operating order or can be fixed during time of lease. No rate adjustments or refund will be made for equipment or appliance failures unless substantial loss of experience is caused (e.g. broken oven). Rate adjustments or refunds will be considered in case of substantial loss of power, water, or gas.  â€‹

Cancellations

​​​​​​​​​​​​​​​EVENTS COVERED FOR GUESTS: Events covered under the General Cancellations Policy include things like:

  • Events that impact Guest or their ability to travel, but do not impact the Property location

  • Unexpected injury or illness

  • Government obligations like jury duty or court appearances

  • Non-binding travel advisories or other government guidance that fall short of a travel ban or prohibition

  • Cancellation or rescheduling of an event (such as a wedding) for which the reservation was made

  • Transportation disruptions unrelated to a covered event, such as airline insolvency, transportation strikes and road closures due to maintenance

 

EVENTS COVERED FOR PROPERTY OWNERS: The Property Owners may also have to cancel a Guest’s reservation due to valid reasons. In this case, Guests will be given a full refund/offered credit on their reservation. Valid reasons include things like:

  • Circumstances beyond Property Owners’ control, such as major damage to the Property, emergency repairs (like a gas leak or a burst pipe) or serious personal illness that prevents hosting

  • Scheduling error with website calendar

  • Property Owners’ experience with Guest prior to commencing the term of lease is, or has been in the past, highly unfavourable. This includes poor behaviour, rude communication or any kind of ill-intent/threats and abuse from Guest.

 

EXTENUATING CIRCUMSTANCES POLICY

Guest and Property Owners can choose to cancel a reservation due to extenuating circumstances. In this case, a full refund/credit will be returned to Guest and the selected dates of the reservation will remained blocked out on the booking calendar. Property Owners will evaluate whether cancellation reasons are extenuating or not. The following events are included under ‘extenuating circumstances’:

 

  • Declared public health emergencies and epidemics

  • Government travel restrictions

  • Military actions and other hostilities

  • Large-scale outages of essential utilities

  • Natural disasters or other severe weather events

Clearys Corner is a slow stay holiday rental that exists on the Land of the Payintaymirimina People of the Oyster Bay nation in south-east lutruwita/Tasmania. We acknowledge the palawa People as the Traditional Owners of the land where we live and share space with others and pay respects to Elders past, present and emerging.
